The Practice Note provides an in-depth overview of product recalls for retailers, distributors, manufacturers, or suppliers of goods in China.The Practice Note outlines the applicable legislation governing defective general consumer product recalls and elaborates on the role and powers of the State Administration for Market Regulation (SAMR). It also covers the differences between consumer and industry-specific product recall requirements and the authorities that enforce them. Next to the details the voluntary and mandatory recall processes for general consumer products including the triggers of a recall, reporting obligations of manufacturers, distributors and retailers, and the information they must provide to the public via channels for such disclosure, the Practice Note also discusses the key contents that a product recall plan must include, such as product quarantine, collection, and disposal. Furthermore, consumers' rights to claim for compensation or refund for a defective product are outlined. Moreover, the authors highlight the steps that a Chinese importer of a consumer product must take when a product is defective and foreign manufacturers' obligations to comply with Chinese law on product quality and consumer rights protection. The potential liabilities of manufacturers, importers, distributors and retailers for failure to comply with recall requirements are outlined in detail, including potential administrative and criminal sanctions in addition to liability in tort or contract.
