近日，海問律師事務(wù)所吳瓊律師和劉宇翔律師受邀在《中國法律商務(wù)》（China Law & Practice）發(fā)表關(guān)于《最高人民法院關(guān)于審理勞動爭議案件適用法律問題的解釋（二）》（“《司法解釋二》”）的深度解讀，團隊成員陳青青律師、莊曉怡律師參與撰寫。該期刊隸屬于國際知名法律出版機構(gòu)ALM集團，長期致力于為大型跨國公司、政府組織以及律師事務(wù)所提供關(guān)于中國法律發(fā)展的最新資訊。
Recently, Wu Qiong and Liu Yuxiang, Partners at Haiwen & Partners’ Labor Law team, were invited to contribute an in-depth commentary on the Interpretation on Issues of Application of the Law in the Trial of Labor Dispute Cases (II) (“Interpretation II”) issued by the Supreme People’s Court to China Law & Practice. Associates Chen Qingqing and Zhuang Xiaoyi assisted in the drafting. China Law & Practice is a well-known legal publication under the internationally renowned ALM Group, which has been dedicated to providing multinational companies, government organizations, and top law firms with the latest updates on China’s legal developments.
《司法解釋二》由最高人民法院于2025年7月31日發(fā)布，是對勞動爭議相關(guān)法律規(guī)定和實踐的重要解釋，對企業(yè)用工行為和勞動管理有深遠影響。本篇文章總結(jié)并評述了《司法解釋二》中關(guān)于勞動合同管理和續(xù)簽的條款，分析討論了競業(yè)限制義務(wù)、特殊待遇所產(chǎn)生的服務(wù)期、違法解除的繼續(xù)履行后果的相關(guān)規(guī)則，不僅從法律技術(shù)層面提供了清晰解讀，也結(jié)合實務(wù)對用人單位的合規(guī)管理提出了策略性建議。
Issued by the Supreme People’s Court on 31 July 2025, Interpretation II provides important clarifications on laws and practices relating to employment disputes, with far-reaching implications for corporate employment practices and labor management. Our article summarizes and evaluates the provisions relating to the employment contract management and renewal, analyzes and discusses rules on non-compete obligations, service periods arising from special benefits, and the reinstatement in case of wrongful termination in Interpretation II. We not only provided technical clarity on the legal rules, but also provides strategic insight and compliance management recommendations for employers.
